As a general rule, you should give the FDD to a prospective franchisee before you have serious conversations about the sale or possible sale of a franchise. If a prospective franchisee requests a copy of your FDD, you must give it to him/her even if you have just started the sales process and you would not have otherwise given the FDD to that prospective franchisee at that time. In most cases we are sending the FDD right after the prospect attends discovery day. If you feel the prospect is ready for it sooner then by all means send it to them so the holding period can start.
The prospect needs to hold the document for review for full 14 calendar days before we can accept signatures and/or money from them, we do not count the day we emailed it to them. For example if we email the FDD to a prospect on the 1st of the month the earliest we can collect signatures on the franchise agreement and money for the franchise fee is on the 16th (so you will hear us talk about the 16 day holding period).
When you email the prospect the FDD you will email them the FDD Receipt Confirmation Form from Salesforce along with it. When they click the form and submit it back to us it will record that info into the Salesforce record.
